Guest opinion: Governments that disarm people lessen their safety

I think a little history lesson is in order. Let's start out with the Second Amendment: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

"Siendo necesaria una milicia bien ordenada para la seguridad de un Estado Libre, no se violará el derecho del pueblo a poseer y portar armas."

I know what you're thinking, "Great. Anyone who starts out with that is a gun nut!" Not true. I'd like to focus on the last word in that sentence: "infringed."

Se lo que está pensando: "Grandioso. Cualquiera que comienza con ese argumento es un loco fanático de las armas! Pero no es cierto. Quisiera enfocarme en la última parabra de esta oración: "violará".

That word means the right already existed prior to the creation of the Constitution. It's already there so don't bother it.

Esa palabra evidencia que el derecho existía previo a la creación de la Constitución. Ya existía para entonces, así que no lo perturben.

Another amendment we need to look at is the 14th.

The 14th Amendment came about after the Civil War and it includes a section called the Due Process Clause that reads, in part: "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States ..."

La 14ta Enmienda surgió luego de la Guerra Civil e incluye una sección llamada la Cláusula del Debido Proceso que dice, en un fragmento: Ningún Estado podrá dictar ni dar efecto a cualquier ley que limite los privilegios o inmunidades de los ciudadanos de los Estados Unidos..."

This clause is very important as it clearly says the state cannot deprive me of certain rights. Let's talk about this whole life, liberty and pursuit of happiness thing guaranteed by the Declaration of Independence.

La importancia de ésta cláusula radica en que explícitamente el estado no puede privarme de ciertos derechos. Hablemos de la vida, de la libertad y de el aspirar a la felicidad garantizado esto por la Declaración de Independencia.

How can any creature on this earth attempt any of those attributes without the ability to defend itself? It's a right at birth.

Cómo puede cualquier criatura en esta tierra aspirar a esos atributos sin la capacidad de defenderse a sí misma? El poder defenderse es un derecho que existe desde el mismo nacimiento.

Let's assume you're walking to your car after work and Mr. Dirtbag decides he has chosen you to rob at knifepoint. I doubt at that moment you will be pursuing happiness. In fact your life might come to a screeching halt as well.

So it is only logical that your ability to defend your life is a natural right.

The Supreme Court of the United States' recent Second Amendment decision McDonald v. Chicago was 5-4. That's a bit close if you ask me. The court spoke about the 14th Amendment and applied the Incorporation Doctrine to the Second Amendment.

El Tribunal Supremo de los Estados Unidos, en una decisión relacionada a la Segunda Enmienda, caso McDonald vs. Chicago, determinó en una votación 5 - 4 a favor del derecho individual a tener y portar armas que le representa al ciudadano americano dicha enmienda. Dicha votación fué una disputada, si me preguntaran. La corte también habló acerca de la 14ta Enmienda y aplicó la Incorporación de Doctrina a la Segunda Enmienda.

This is a big decision because it only had been applied to most of the first 10 amendments, though not the Second - until now.

Esta es una gran decisión porque esto se había aplicado a la mayoría de las primeras diez enmiendas, pero no a la Segunda Enmienda, hasta ahora.

The recent Heller decision extended gun ownership only to the District of Columbia and other areas under federal control. However, the McDonald decision extends an individual's right to keep and bear arms to all 50 states.

La reciente decisión Heller (Heller vs. District of Columbia, http://www.supremecourt.gov/opinions/07pdf/07-290.pdf ) extendió la posesión de armas solo al Distrito de Columbia y otras áreas bajo control federal. Gun control advocates always cry that blood will run in the streets if we allow private citizens to own handguns.

However, they always seem to somehow ignore crime statistics. Since Heller was issued two years ago to allow private gun ownership in D.C., its crime rate has dropped 25 percent.

Sin embargo, parecen ignorar de alguna manera las estadísticas referentes al índice de criminalidad. Luego de la decisión Heller, que hace dos años atrás permitió la posesión privada de armas en el Distrito de Columbia, el índice de criminalidad en la región ha disminuído en un 25 %.

The 18th-century Italian philosopher Cesare Beccaria once wrote "laws that forbid the carrying of arms ... disarm only those who are neither inclined nor determined to commit crimes. ... Such laws make things worse for the assaulted and better for the assailants ..."

El filósofo italiano Cesare Beccaria una vez escribió que "las leyes que prohíben la portación de armas, desarman sólo a aquellos que ni están inclinados ni determinados a cometer crímenes. Dichas leyes solo empeoran la situación de las víctimas del crimen y le facilitan la vida a los asaltantes..."

I think the powers that be need to understand something. This is the people's right - an unalienable right that predates any form of government and that cannot be taken away.

Pienso en lo que es necesario para entender algo. Este es un derecho del pueblo en su carácter individual - un derecho inalienable que proteje al pueblo y que en definitiva, no le puede ser limitado.

Las leyes para el control de armas vienen en contra del ciudadano decente y honesto y facilitan la vida al delincuente, por lo que lesionan el derecho natural del hombre a la autodefensa.
