Agreeing with the position of the NRA and the firearms industry, the agency explained in a news release that it "does not have the legal authority to regulate this type of product under the Toxic Substances Control Act (TSCA)." La dama que inicialmente se pensó podría ser cómplice y que sufrió una crisis de nervios, en realidad se trataba de una persona presente en el lugar aunque la Policía no precisó si se trata de una cliente de la tienda, o una empleada. De acuerdo al informe de la Policía el guardia de seguridad del establecimiento le hizo siete disparos al asaltante, quien fue llevado al hospital San Francisco, donde murió.
